Order information

Please ensure that all the information supplied (including postcodes) is correct, as The Cheese and Wine Shop of Wellington reserves the right to charge increased delivery charges, if incorrect information has been submitted, and as a result surcharges are incurred. To ensure speedy and correct delivery, please ensure all contact and delivery details are accurate, failure to do so may lead to increased costs, and late delivery.

Urgent Orders

For urgent orders, we urge you to call and or send an email to confirm that we have received your order. As great as the Internet, and computers are, neither are immune from power cuts, server problems and interruptions to service. So please, if you need something for next day delivery, do ensure that we have received your order with a phone call.

Delivery

If your parcel is urgent, you must select the next day delivery option at checkout. If in the unlikely event that your parcel is not delivered within the designated time, our delivery partners will upgrade it to the next available service. Sending Gifts

If you are buying as a gift, or having goods delivered to a 3rd party, it is essential that they will be in to receive the parcel/s. When asked, we do instruct the couriers to leave the parcel in a safe place, and this works well, but this is done at your risk. Please read here. This often is available at checkout under "Leave Notes"

Non-Delivery

The Cheese and Wine Shop of Wellington cannot be held responsible for the non-delivery of goods. We, along with our delivery partners, Ukmail will do everything possible to ensure swift dispatch of parcels, but please help us by supplying full and correct contact information, as outlined here. Please allow sufficient time during the busy Christmas period to allow for adverse weather delay due to poor road conditions.


Packaging and Images

Packaging does change, and it may be that the image on the web site is out of step with the product. We WILL send the product, regardless of the packaging change, as long as the weight and contents are the same. 

If is important that the product is exactly as in the image on the web site, please advise this in the order comments. (ie; "Must be same as image on web site") that way, if there's any difference, we wont send it! 

If you haven't this on your order, you can return the items, at your cost, to us for a full refund of the product/s.

Payment

Payment is taken when you place your order, using Sagepay. If there is any problem, we will contact you by email, or phone to arrange a credit, or to take your card details for any additional items.

Faulty goods / Refunds

We hope that you, the customer, will be delighted with your purchase, but if for any reason you choose to return the items to us you may do so by completing a RNA on line, or by calling us on 01823 662899 within 2 days from the receipt of your order. In such circumstances, please your name and order number to hand.

We will then contact you via e-mail to inform you of the process required in returning the goods to us. During thistime, it is your responsibility to look after the goods and maintain them in anunopened re-saleable condition - this includes the container in which the goods were delivered.

If we arrange for our Courier to collect the goods from you, we will refund you the difference between the price paid for the goods and the cost to us of collection of such goods. If you decide to return the goods at your cost, then we will refund the full amount paid for the goods - however, in this case it is the responsibility of you, the customer, to ensure that an efficient delivery/carrier service is used to return the goods with adequate insurance to cover you for damages that may occur in transit. Under no circumstances will refunds be made if returned goods are returned in a damaged, or unsaleable state. It is imperative that you send goods back to us using a method that records a signature, and covers the product for any damage.

Please note that any bespoke goods or services ordered by you, including Hampers, and orders that are made to your specific requirements are not included in this returns policy. Any orders that contain perishable food items are also excluded. (Unless received in a damaged condition)

Refunds will be made within 14 working days of return of goods, or order cancellation.

Damaged Goods

Every item we sell is carefully inspected before it is shipped. Please notify us immediately upon receipt of the goods if any of the products are damaged. All claims must be made within 24 hours of receipt of goods, and all damaged goods must be returned to The Cheese and Wine Shop of Wellington.

Changed your mind? No problem, you can return the goods at your cost,and upon receipt, we will refund the cost of the goods. Returned goods must be in absolutely new and unused condition for refund. No refund will be considered, where failure to deliver the goods, was due to incorrect information being submitted on the original order.

Please complete a return form through our web site. You must log into your account, and under orders, there is an option to select a RMA. Once we have the goods returned, we will issue the appropriate refund.

Any items that are missing, or damaged will be credited to your account.

The Cheese and Wine Shop of Wellington does not represent or warrant that the information contained on this site is complete or free from error, and expressly disclaims and does not assume any liability to any person for any loss or damage whatsoever caused by errors or omissions in the data or the software, whether such errors or omissions result from negligence, accident, quality, performance of the software, or any other cause. 

Furthermore, by using this website, you accept that all copyright of Text and Images remains with The Cheese and Wine Shop of Wellington. If you are aware of any images that are not copyright of The Cheese and Wine Shop, you must advise The Cheese and Wine Shop and they will be updated or removed immediately.

Orders That Have Alcoholic Content

Please note that under the Licensing Act 1964 it is an offence for someone under 18 to buy, or attempt to buy, intoxicating drinks, or for adults to buy or attempt to buy on their behalf. The maximum penalty is a fine of £1000. Some of the products offered for sale on this site contain intoxicating drinks. In accepting these terms and conditions, if you are purchasing products that contain intoxicating drinks,you are confirming that you are over the age of 18 and legally allowed to purchase alcoholic drinks and that they are not being sent to anyone under the age of 18.

Out of Stocks

With 1000s of products in our busy shop, occasionally we do have an out of stock. You will be prompted during checkout as to what action you would like us to take if an item you have ordered is out of stock. To avoid holding up your parcel, and especially at busy times like Christmas, we strongly suggest allowing us to substitute any out of stocks for similar products.

Price Changes

While The Cheese and Wine Shop tries to ensure that all prices on this website are accurate, errors may occur. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.

If they are unable to contact you, they will treat the order as cancelled. Under exceptional circumstances beyond our control, The Cheese and Wine Shop of Wellington reserves the right to alter prices without prior notification. The price charged is the price ruling on the day of dispatch.

In the event of any Price changes, we will notify you before dispatching goods.

If there is a price change, either due to a mistake that we have under priced an item, or due to a supplier price change, your options will be;

provided that we notify you, by email or phone, before we dispatch the item to you.

Contract creation and electronic contracting

Once you place an order online, it is classed as an offer. By proceeding through the ‘checkout process’ and ticking the ‘Accept’ tick-box detailing these Terms and Conditions, you agree to these Terms and Conditions, and you are making an offer to purchase goods which, if accepted by The Cheese and Wine Shop, will result in a binding contract.

We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from The Cheese and Wine Shop.

As your product is shipped we will send you a dispatch confirmation email.

Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it in writing to us, at least 48 hours before dispatch.

Non-acceptance of an order may be a result of one of the following:

· The product you ordered being unavailable from stock.

· Our inability to obtain authorization for your payment.

· The identification of a pricing or product description error.

Change your order

We're sorry that in most circumstances it's not possible to make changes to your order once you've placed it. If you'd like to add products to your order, please place a new order for these items.

If you need to change details of your delivery address, remove items from your order or cancel it completely, please contact our Customer Services team for advice on 01823662899 between 9am and 4.00pm, Monday to Saturday.

You can leave a message on our answer phone outside these times, Please quote your order number and name and order delivery date. You can also email us here.

Cancel your order

If you need to cancel your order, please email the order confirmation back to us, and advise that you would like to cancel. During the busy Christmas period, please allow upto 7 days for processing. If your parcel arrives, please DO NOT accept it; decline the delivery and it will be returned to us. If the courier attempts redeliver, please decline it and call or email us immediately. If you accept it, then it will be treated as delivered, and regretfully, no refund can be made.

During December, and the busy Christmas period, please allow extra time for processing your enquiry. Any refunds or adjustments can take upto 14 days to process.

Our rights

We reserve the right to:

· modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website;and/or

· change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

To provide increased value to our Users, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.

Circumstances beyond our control

Whilst all here at Cheese and Wine Shop will make every effort to fulfill orders with expediency, occasions may arise when this may not be possible due to circumstances beyond our control for example - but not limited to - Acts of God, Acts of Government, Fire, Flood, Labour Disputes, Lockouts, Drought, Strike or War, Explosion, Civil Disturbance, Technical failures with logistics, power transmission, telecommunications and information technology.
