This website is operated by The Cheese and Wine Shop of Wellington. Throughout the site, the terms “we”, “us” and “our” refer to The Cheese and Wine Shop of Wellington. The Cheese and Wine Shop of Wellington offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse Service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Any reliance on the material on this site is at your own risk. 
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 - PRODUCTS OR SERVICES  

Placing orders; We aim to process and ship all orders within 2 working days subject to stock availability, and no longer than 12 working days.

Weighed Items; Cut cheeses; if your order contains cut cheese, please note if its a cut from a bigger piece, and you have ordered its as a Half, Quarter or Eighth the weight indicated is a guide. It WILL BE CUT as a piece, and the weight might be more or less, BUT the cut will be Half, Quarter, Eighth or a Sixteenth of the cheese. The weight will always be within 10% of the guide weight. 

Payment is taken when you order. Should any information be missing we will contact you. Once the order has been accepted and processed you will receive a confirmation email. 

The Cheese and Wine Shop retains the right to refuse any orders should they see fit to do so.

Price; Upon completion of order payment will be made. Prices shown will be inclusive of VAT but excluding delivery. Prices of items shown will be the price of the item upon payment.

Prices may change at any point without prior notice.

Substitution; Goods are subject to availability. Occasionally products maybe unavailable, should this happen a suitable replacement will be made – if you do not wish a substitute to be made please note in comments we will then contact you to source an alternative. We only send complete orders; in the case where an item is missing we will substitute it with a similar cheese of equal or greater value. If you don’t want a substitution, please advise us when ordering. 

SECTION 6 - PAYMENT & DELIVERY

The Cheese and Wine Shop accepts most major payment types. Payment is made using Shopify Payments a secure online form of payment.

Payments will appear on your statement as The Cheese and Wine Shop of Wellington

Delivery
We aim to process and ship all orders using your chosen delivery or collection date, subject to stock availability. In the event of any problem, we will contact you as soon as possible to outline options.

We use a courier, normally DHL or Royal Mail, to deliver your orders. We package your cheese with ice packs and make sure its extra secure. We re-use packaging to reduce wastage and keep costs as low as possible.

Deliveries are made Wednesday to Friday, or Saturday at extra cost. A delivery date that suits you can also be chosen, earliest delivery for these orders is 2 working days lead time. Please Note, There is NO delivery on Public holidays

Upon checkout alternative delivery instructions must be given & a telephone number in the event you are not in to accept the goods. These instructions can be, but are not limited to the following examples “leave by side near gate” or “leave at number 121 Marshall Drive” (as long as it is a close neighbor on the same road/vicinity). Without this alternative delivery instruction due to the nature of the goods we will be unable to process the order.

SECTION 7 RETURNS & CANCELLATIONS

Should you wish to cancel an order the order must be cancelled on the same day it is placed. For cancellations within a shorter period please contact us directly on 01823 662899 or by email. If the order has already been accepted cancellation will not be possible.

In the case where you are unhappy with your order either due to damage, product issue or error please contact us within 24 hours and we will endeavor to put right any issues.

Returns are only accepted if the goods are damaged. All damaged must be reported by phone, and follow-up email, with photos within 24 hours of receiving the order. If the item is returned to us but is not in its original and unopened packaging we reserve the right to refuse a refund. All deliveries returned must be accompanied by original delivery slip.

We are unable to accept responsibility or refunds with incorrect delivery addresses, unopened parcels, delays caused by weather conditions, or gifts to recipients who are away or unable to receive the goods.

SECTION 8 - DISCLAIMER

Exclusions and Limitations; The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, this Company:
•    Excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature; and
•    Excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.
This Company does not however exclude liability for death or personal injury caused by its negligence.

Unless otherwise stated, the services featured on this website are only available within the United Kingdom, or in relation to postings from the United Kingdom. All advertising is intended solely for the United Kingdom market. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

All our artisan cheeses and accompanying products may be subject to seasonal availability and change in size and shape. All measurements and weights are approximate.

SECTION 9 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
